(1) A good starting point is to become familiar with the Declaration of Restrictive Covenants document.
(2) Next print and complete the Application to Construct Residence and/or Structure(s) document. If you answer ‘No’ to questions 1-7 on the Residence or New Structure Section on page 2, then email the completed application to secretary@dogwoodspringshoa.com. The ACC will either approve or disapprove within 45 days after receipt of a completed application.
(3) If you answer ‘Yes’ to ANY of the questions 1-7 on the Residence or New Structure Section on page 2, the ACC cannot approve the application because it is outside the HOA Deed Restrictions guidance. You have an option to continue with the application process by completing the Variance Request Form on page 4 of the Application to Construct Residence and/or Structures document. The Variance Request form allows you to provide rational for why you are requesting a variance to the deed restrictions. Submit it along with your Application to Construct Residence and/or Structure(s) by email to secretary@dogwoodspringshoa.com. The variance request will facilitate a HOA Board Hearing to be conducted within 30 days after receipt of a completed application with variance form. The determination of the Board is final.
(4) If an application is denied by the ACC, the owner may appeal the action of the ACC to the Board by giving written notice of the appeal to the Board. The Board shall determine the appeal within 20 days after receiving the appeal. The determination of the Board is final.
